The Delhi High Court declared Nutella, the hazelnut cocoa spread by Ferrero, as a well-known trademark in India, ruling against Thane-based MB Enterprises for selling counterfeit products. The court acknowledged Nutella’s uninterrupted presence in India since 2009, global prominence since 1964, and distinctiveness in the market. Ferrero was awarded damages and a permanent injunction against further infringement.
